Terms of Service
These terms govern use of Hire Car, a marketplace that helps customers discover and contact independent rental vendors.
Platform role
Hire Car provides listing, search, lead, messaging, review, and subscription tools. Hire Car is not the rental operator, vehicle owner, insurer, finance provider, broker, or travel agent for any customer rental unless expressly stated in writing.
Vendors set their own availability, rental prices, deposits, identification requirements, insurance conditions, cancellation rules, and rental agreements. Customers must review and accept the vendor's direct rental terms before hiring a vehicle.
Accounts and eligibility
You must provide accurate account, contact, billing, and business information. You are responsible for activity under your account and for keeping login credentials secure.
Vendor accounts may be approved, rejected, suspended, or removed where Hire Car reasonably considers this necessary for fraud prevention, marketplace quality, legal compliance, payment risk, or customer safety.
Customer enquiries
Submitting an enquiry does not guarantee a booking. A booking is formed only when the customer and vendor agree the rental terms directly.
Customers must provide accurate contact details, pickup information, dates, and messages. Vendors must handle enquiries promptly and must not use customer contact details for unrelated marketing without a lawful basis.
Australian Consumer Law
Nothing in these terms excludes, restricts, or modifies rights, guarantees, remedies, or protections that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
Where a vendor supplies rental services to a customer, the vendor remains responsible for consumer guarantees and other obligations that apply to that supply.
Reviews and marketplace content
Reviews must reflect genuine customer experiences. Hire Car may moderate, reject, remove, or investigate reviews and listings that appear fake, misleading, abusive, incentivised without disclosure, or unrelated to an actual marketplace interaction.
Users must not post content that is unlawful, misleading, defamatory, discriminatory, abusive, sexually explicit, spam, malware, or designed to interfere with the platform.
Service changes and availability
Hire Car may change, suspend, or discontinue platform features where reasonably required for maintenance, security, performance, legal compliance, commercial viability, or product improvement.
Hire Car aims to provide a reliable service but does not guarantee uninterrupted availability. Planned or emergency maintenance may affect access.
Liability
To the maximum extent permitted by law, Hire Car is not responsible for vehicle condition, vendor conduct, customer conduct, rental disputes, accidents, fines, tolls, deposits, insurance decisions, or losses arising from rental agreements between customers and vendors.
Hire Car's liability is limited to the remedies required by applicable law and, where lawful, to resupplying the affected platform service or refunding the fees paid to Hire Car for that affected service.
